We look forward to serving you and want all parties to have a positive and rewarding experience.  We want you to enjoy your golf cart, electric vehicle and accessories and here are some of our terms and conditions.  There may be others noted on your estimate or invoice.

Sales Tax

State sales tax is charged on instate orders if required by law.  Sales tax will be collected for all vehicles based on applicable laws for each state.

Payment Method Options

Orders accepted via secure online forms and pages only. Major credit cards are accepted at discretion of Bright EV or our partner and dealer partnerships. Credit card purchases verified for your protection. Checks accepted with dealership manager approval.  Wire payments are best form of payment to prevent vehicle delivery delays.  Cash only accepted with dealership manager approval.

Backorder of Vehicles or Accessory Items

Backorders: If an item is backordered, we will notify you via voice call, email and or text message. Backorders will be fulfilled when the backordered items become available.

BEV Secured Online Shopping

Your order’s privacy and security over the web is insured by using and industry standard an SSL secure server connection.

Product, Order and Pricing Disclaimers

Product descriptions or claims of the manufacturer and/or dealer and/or distributor are NOT guaranteed to be accurate. ALL Prices subject to change without notice at any time. Prices posted in error by human or technology and/or options on the website do not obligate us to honor those incorrect prices and/or options and so forth. We reserve the right to refuse to sell to anyone and any business for any reason at any time.

Product Shipping and Handling to US and Abroad

Product Shipping and handling charges for vehicles and accessories are based on your location and items shipped.  

Heavy and oversize vehicles and accessories may have an additional shipping cost. This charge may not be calculated until the order is being prepared and ready for shipping.

We will notify you if there is an increase in the shipping charge for your order prior to shipping.  If new shipping cost is not accepted by client then client may arrange for shipping at their own expense.

Our shipping is provided by FedEx, UPS Ground/UPS Air Common Carrier or US Postal Service in the continental US. Shipments to Alaska & Hawaii and Mexico will have additional shipping costs applied.

Other out of United States orders will have an additional shipping cost as well.

Allow up to 30 business days for delivery of non-backordered items in the continental US. Allow additional time for shipments to Alaska, Hawaii and Worldwide Orders.

Consolidated Shipments: Entire orders will be shipped together if possible but may be shipped separately at discretion of Bright EV or partners.

Vehicle and Product Returns and Exchanges

All sales are final unless specifically noted otherwise on invoice.  Client may request return or exchange for dealership that provided the vehicle or product.

If accepted, product returns or exchange must be in original new condition and must include all instructions and original packing materials, etc. Customer will pay all return shipping charges and include a copy of packing list with all returned or exchange items

Original shipping and handling charges are not refundable. Returns must be preauthorized by us and are subject to a 21% re-stocking fee. These amounts will be deducted from the original amount billed and the remaining balance will be credited to the original credit card.

Wrong Item: If you received an incorrect item no extra charges will be incurred. We will replace incorrect items and pay the additional shipping charge.

Wrong Size: 

Wrong Customer Order: Client responsible for ordering correct size vehicle(s), accessories and merchandise.  BEV may exchange with manager approval.  No refunds for customer order errors unless approved by dealership manager. Incorrect customer placed orders can be exchanged for any other item without paying the restocking charge. However, the customer will pay the additional shipping and handling charge. The replacement item must be at least 90% of the value of the original item.

Return Shipping Instructions: Return via prepaid UPS or US mail. Insure shipment for full value of purchase. Use original packaging. We are not responsible for packages lost during return shipping, no credit or exchange if we don’t receive item(s).  Please enclose a copy of your packing list or email Invoice along with detailed return/exchange instructions. Send exchanges and returns to dealership.

This Special Privacy Notice for California Residents supplements and is expressly made part of our privacy policy and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). Your Access to Specific Information and Data Portability Rights

You have the right to request that Bright Electric Vehicles, LLC, disclose certain information to you about our collection and use of your personal information over the past 12 months. Your Deletion Request Rights

You have the right to request that Bright Electric Vehicles, LLC, delete any of your personal information that we collected from you within the last 12 months and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

Bright Electric Vehicles, LLC may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Your Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by filling out the Consumer Privacy form.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Bright Electric Vehicles, LLC cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Our Response Timing, Format and Methods

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination Policy

Bright Electric Vehicles, LLC will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

Your Other California Privacy Rights

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Websites that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Prices, terms and conditions are subject to change without notice. Odometers on golf carts are only for estimated mileage and not to be considered accurate like other motor vehicles. Vehicle transportation and labor charges are not covered under factory warranty. I hereby grant Bright Electric Vehicles, LLC (BEV) and all associated auto dealer partnerships, permission to operate the vehicle herein described for the purpose of testing and inspection. A lien is hereby acknowledged on client vehicle to secure the cost of repairs. (BEV) and all associated auto dealer partnerships is not responsible for loss or damage to vehicle or articles left in vehicle in case of fire, theft, accident, or any other cause. Customer takes full responsibility for the operation of vehicle and will not hold (BEV) and all associated auto dealer partnerships responsible for any misuse and handling that could result in injury or death. All sales are final. Non-refundable full payment is due at the time of purchase, unless otherwise agreed upon management. Both parties agree that any contract disputes are to be resolved with arbitration or mediation.

ACCEPTANCE OF ORDERS:

The receipt of an e-mail order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. BEV and All associated dealerships reserves the right, without prior notification, to limit the order quantity on any item and/or refuse service to any customer. Verification of information may be required prior to the acceptance of any order. By placing a credit card order, the customer grants the All associated vehicle dealerships permission to contact their bank to verify name and address.

LSV Requirements

NHTSA (National Highway Traffic Safety Administration) issued a mandate that requires hybrids and electric vehicles travelling at less than 18.6 mph (30 km/h) to emit warning sounds that pedestrians must be able to hear over background noises- The regulation requires full compliance in all electric vehicles, including LSVs. Because of the quietness of electric vehicles and the possibility of collision with visually or audibly impaired pedestrians, the overall objective is to facilitate proximity awareness and minimize the chance of personal injury. In summary, an LSV (legally licensed to drive on streets up to 25 mph> must emit a sound when the forward or reverse switch is in the:

Forward position:

  • From 0 MPH to 18.6 mph.The sound is allowed to stop once the vehicle exceeds 18.6 mph.

Reverse position:
In order to comply with NHTSA rules, all LSV vehicles have a Pedestrian Alert sound generator installed.
